Former Los Angeles County District Attorney George Gascon declined to file charges against two Inglewood police officers determining the fatal shooting of Alexis Pulido on September 16, 2022, was justified use of force.
The Los Angeles County District Attorney’s office completed its investigation dated June 5, 2024, and uploaded it to the department’s website.
The report identifies Inglewood Police Department officers involved in the fatal shooting as Officers Javier Mosely and Robert Swenson.
The incident began at approximately 6:28 p.m. on Sept. 16, 2022, when Pulido knocked on an Inglewood resident’s door seeking to charge his cellphone. When the couple that answered denied his request, he threw a Lysol can through their window.
The couple’s daughter contacted police while her parents followed Pulido in their vehicle.
Swenson was the first to arrive on the scene with Mosely arriving shortly thereafter.
The officers then made contact with Pulido at another location, where Pulido claimed to live at, where another resident stated he was “trespassing” and was “possibly armed” and “mentally unstable”.
Mosely and Swenson planned to apprehend Pulido and as they approached him to grab him by his arms, a tussle ensued, with Pulido taking control of Mosely’s service weapon and discharging it.
The report indicates Mosely and Swenson gave conflicting accounts of what happened.
“Swenson stated that he fired at Pulido while Pulido still held Mosely’s handgun in his hand and Mosely was attempting to take it away. Swenson stated that after the shooting Mosely was “holding [his handgun] by the holster” and asked Swenson if he had been shot. Swenson checked him and made sure he was not shot and asked Mosely to place his gun down before Swenson administered first aid to Pulido. In contrast, Mosely stated that after Swenson fired his service handgun, Mosely “backed off” of Pulido, and observed his service gun was behind him. He stated he didn’t touch it.”
The report indicates the actual shooting of Pulido was not caught on camera as Inglewood officers are not issued body-worn cameras as provided to Los Angeles Police Department officers and Los Angeles County Sheriff’s Department deputies.
The Los Angeles County Medical Examiner’s autopsy report indicates Pulido’s cause of death was “gunshot wounds to the torso” and indicated he was shot six times.
The DA’s report indicates that parts of Mosely’s gun holster were broken and “paper materials” had been inserted at both ends of the holster.
“It was determined that two rivets that held the belt loop in place on the gun belt were broken in half.”
The report does not indicate if the holster was broken before or during the incident with Pulido.
During a special city council meeting held on Dec. 19, city officials met in closed session to discuss a possible settlement with Pulido’s estate.
Acting City Attorney Rick Olivarez did not report to the public any actions taken during the closed session or which council members were present during the late afternoon meeting.
